This appeal is directed against order dated 25.02.2026 passed by the Commercial Court - I, Agra whereby the application filed by the appellants under Order XXI Rule 58 CPC has been rejected. 2. A civil suit for recovery of money being CS (OS) No. 1703 of 2002 was filed before the Delhi High Court against respondents no. 2, 3, 4, 5 and father of appellants no. 1 and 2, which suit was decreed ex-parte with cost. 3. Execution was laid in the District Court, Karkarduma, Delhi and was transferred to the court of District Judge, Agra. On 13.02.2017 the Delhi Court issued Precepts to District Judge, Agra for attachment of various properties, including the property forming subject matter of application under Order XXI Rule 58 CPC.
