Learned counsel for the applicant submits that an agreement was entered into between the parties and work was completed on 25.2.2016. He submits that after completing the work, the petitioner submitted bills for payment before the opposite party in the year 2016 but the same has not been paid till date. He submits that petitioner has earlier approached this Court by filing Writ C No. 36482/2022, which was disposed of as withdraw vide order 1.12.2022 with liberty to the petitioner to invoke the arbitration clause, thereafter, the applicant has sent notice for appointment of sole arbitration but no consented arbitration could be appointed.
