The present 528 B.N.S.S. application has been filed to quash the impugned summoning order dated 05.03.2024 as well as entire proceedings in Complaint Case No.1542 of 2021 (M/s India Build Sources vs. Straight Edge Contracts and others), under Section 138 N.I.Act, Police Station Indirapuram, District Ghaziabad. 3. It is alleged in the complaint that the applicant issued cheque in favour of opposite party no.2 and same was dischonoured on presentation before the Bank. When amount was not paid, statutory notice was given to the applicants by the opposite party no.2 . Then present complaint has filed. Learned counsel for the applicants submits that summoning by learned Magistrate is without application of judicial mind and prima- facie no offence under alleged section is made out. W
