The instant application under Section 528 BNSS has been filed by applicant with the prayer to quash the charge sheet, cognizance order as well as the proceedings of Case No. 424 of 2012 (State Vs. Suresh and others), arising out of Case Crime No.157 of 1999, under Sections 363, 366 IPC, P.S. Bhagatpur, District Moradabad, pending in the court of A.C.J.M.-I, Moradabad. 3. It is jointly contended by learned counsel for parties that the accused applicant is named in FIR dated 21.07.1999 lodged by father of victim for enticement. The charge sheet is submitted against three accused including the applicant.
