The instant application under Section 528 BNSS has been filed by applicants to quash the entire proceeding of Criminal Case No. 1441 of 2019 (State Vs. Shamsher & others) arising out of Case Crime No. 134 of 2019, under Sections 420, 467 and 468 IPC, P.S.- Kilan, District- Bareilly, pending in the court of Additional Chief Judicial Magistrate-III, Bareilly as well as cognizance order dated 01.08.2019 and charge sheet dated 29.06.2019. 3. Learned counsel while putting the case submits that the FIR has been lodged by opposite party no.2 against the accused/applicants with the allegation that the accused/applicant has usurped the payment being made by the owner in favour of opposite party no.2 for supplying of material. The role of applicant in the matter is only of a middleman as he has introduced opposite party no.2 with the co-accused
