The instant application is being filed by the applicant to quash the charge sheet dated 14.04.2020, cognizance/ summoning order dated 04.01.2021 passed by learned Judicial Magistrate-II, Ballia in Case No. 56 of 2021 (arising out of Case Crime No. 05 of 2020), under Sections 147, 148, 149 and 323 IPC, Police Station- Sahtawar, District- Ballia, pending in the Court of the learned Civil Judge (Junior Division)/Fast Track Court-III, Ballia 3. It is jointly contended by the learned counsel for the parties that the accused/applicant and opposite party are of same village. The fight between the two occurred at the function in a village.
