The instant application under Section 528 BNSS has been filed by applicant to quash the charge sheet dated 21.08.2024, cognizance order dated 11.02.2025, bailable warrant dated 04.09.2025 and the entire proceeding of Criminal Case No. 40076 of 2025 (State Vs. Sukheeram and others), arising out of Case Crime No. 0256 of 2024, under Sections 115(2), 118(1), 333, 351(2) of BNS, Police Station- Kanth, District- Moradabad, pending before the court of Additional Civil Judge (J.D.)/J.M. Court No.4, Moradabad. 3. It is jointly contended by the learned counsel for the parties that the F.I.R. has been lodged by the opposite party no.2 against the accused- applicant
