Present application under Section 528 BNSS has been preferred for quashing the entire criminal proceedings of Session Trial No. 130 of 2022 (State Versus Shamshad) arising out of Case Crime No. 362 of 2021, under Section 376 I.P.C., Police Station Swar, District Rampur bearing Charge Sheet No. 04 of 2022, dated 06.01.2022 as well as cognizance order and summoning order dated 18.01.2022, pending in the court of Additional Sessions Judge/Fast Track Court-I, District-Rampur. 3. It is submitted by the learned counsel for the applicant that a false FIR was lodged against the applicant on 08.08.2021 as Case Crime No.362 of 2021 at Police Station Swar, District Rampur, under Section 376 I.P.C. The Investigating Officer wrongly and illegally submitted the charge-sheet in this case on 06.01.
