The instant application under section 528 BNSS has been preferred to quash the charge-sheet dated 31.03.2025 and cognizance/summoning order dated 01.08.2025 as well as the entire proceedings of Case No.593 of 2025 (State vs. Hani Sharma & Others) arising out of Case Crime No.21 of 2025, under sections 115(2), 352, 351(2), 110 IPC, P.S. Badalpur, District- Gautam Buddh Nagar, pending in the court of learned Civil Judge (JD) FTC 1st, Gautam Buddh Nagar. 3. Learned counsel for applicant argued that applicant has been falsely implicated in the present case by opposite party no.2 only on account of his friendship with co-accused Hani Sharma, since no offence as alleged, has ever been committed by him. It has also been argued by learned counsel for applicant that injured Manoj was fully intoxicated at the time of alleged
