Present application has been preferred with prayer to quash proceeding of Criminal Case no. 10 of 2026 arising out of Case Crime no. 96 of 2025 under section 318(4) BNS, PS-Kotwali, District Rampur along with charge sheet dated 17.11.2025 and cognizance order dated 2.1.2026 passed by learned Additional Chief Judicial Magistrate, Court no. 1, Rampur. 3. Brief facts of the present case is that FIR has been lodged at the behest of opposite party no. 2 against applicant and another co-accused alleging therein that applicant took certain amount of money from informant on the pretext of buying him a house but thereafter applicant neither returned the money nor delivered the property in shape
