This application for leave to appeal under Section 378(3) Cr.P.C. has been filed for appeal against the judgment and order dated 02.05.2006 passed by learned Additional Sessions Judge/FTC, Court No.5, Lakhimpur Kheri in Sessions Trial No.146/2003, under Sections 307/34 and 506 I.P.C., Police Station Kheri, District Kheri, whereby the accused/respondents have been acquitted of the charges by the learned trial court. 3. Learned A.G.A. submits that the impugned judgment and order of acquittal has been passed by the learned trial court without considering the evidence and material on record and dealing it appropriately.
