Heard petitioner in person as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner, who is villager and complainant of alleged misconduct of Lekhpal in some matter, has approached this Court with a prayer for issuing a writ of mandamus to command the Principal Secretary, Revenue Department to hold enquiry into the matter of complaint. In the considered view of the Court, petitioner may raise a plea before the appropriate forum or may maintain a Public Interest Litigation (PIL) through the villagers but cannot maintain a petition to seek remedy in service jurisdiction before this Court. Petitioner has neither any stake in the selection and appointment of the concerned Lekhpal, nor is he member of a service of Revenue Department to raise a plea at the time that if complaint not examined, he stand prejudiced.
