Heard Sri Tarun Shahi, learned Advocate holding brief of Sri Arvind Prabodh Dubey, learned counsel for the petitioner and learned Standing Counsel. By means of this petition under Article 226 of the Constitution of India petitioner has prayed for quashing of the order dated 25.08.2025 passed by Settlement Officer Consolidation, Kushinagar. Learned Standing Counsel has raised a preliminary objection as to the maintainability of the writ petition on the ground that petitioner has an alternative efficacious remedy of statutory appeal under the Uttar Pradesh Government Servant (Discipline and Appeal) Rules, 1999. Learned counsel for the petitioner could not dispute the above legal position.
