By means of present petition filed under Article 226 of the Constitution, petitioner has questioned the charge-sheet dated 26.5.2023 on the ground that petitioner had already retired on 31st January, 2022 and matter relates to the period when petitioner was not posted at the relevant station . It is argued on behalf of the petitioner that respondents have wholly, illegally proceeded to pass order of recovery for a sum of Rs. 6,65,076/- without there being any conclusive finding as to the guilt being proved. Learned Standing Counsel on the contrary submits that petitioner has now approached this Court after a lapse of two years whereas petitioner has already submitted reply to the chargesheet.
