Heard learned counsel for the petitioner Sri S.K.Tiwari, and learned Standing Counsel. By means of present petition filed under Article 226 of the Constitution, petitioner has prayed for quashing of impugned order dated 19.06.2025 passed by Sub Divisional Magistrate, Tehsil-Ajitmal, District Auraiya, whereby services of the petitioner has been reinstated but petitioner has been punished for censure and one increment in salary withheld permanently Learned Standing Counsel has raised preliminary objection as to the maintainability of this petition on the ground that petitioner has alternative efficacious remedy of department appeal under the Uttar Pradesh Government Servant (Discipline and Appeal) Rules,1999. Learned counsel for the petitioner does not dispute the above legal position. In view of aforesaid, while I decline to grant indulgence in the matter, I still provide that if petitioner prefers the depar
