Heard learned counsel for the parties. By means of present petition filed under Article 226 of the Constitution, petitioner has prayed for a writ of mandamus to command respondent to award marks of written examination to the petitioner as well so that his candidature shall be considered for the appointment on the post of CT Cook (Male). Sri S.K.Yadav, learned counsel for the respondent has obtained instructions in the matter and placed the same before this Court, which are taken on record and copy of which is also supplied to the learned counsel for the petitioner. As per instructions, it transpires that petitioner scored only 53 marks as compare to marks obtained by last selected candidate which was 66 under the scheduled caste category.
