By means of present petition filed under Article 226 of the Constitution, petitioner has questioned the notice for penal rent dated 5.6.2025 issued by Deputy Commissioner of Police, Commissionerate, Agra directing the petitioner to vacate the official accommodation on account of transfer to another station. It is contended that in the above regard, petitioner has been issued show notice to vacate the official accommodation else to be levied with penalty, but no prior notice and opportunity of hearing was given to him. In the given facts and circumstances of the case, this petition stands disposed of with direction to the petitioner to submit reply to the notice within a period of two weeks from today and in the event petitioner offers explanation in writing within a period of two weeks as directed hereinabove, the same shall be considered and a final
