By means of this petition filed under Article 226 of the Constitution, petitioner, who is working as Constable in Civil Police since 1987 is seeking promotion to higher post. It is contended that even if there is a criminal case pending against the petitioner, his candidature ought to have been considered and placed in sealed cover. Learned Standing Counsel submits that he may be directed to raise his grievance before the concerned competent authority, who may be disposed of the same in accordance with law. In view of the above, this petition stands disposed of with a direction that in the event petitioner makes a fresh representation regarding his promotion before the respondent no. 2 within a period of four weeks from today along with the certified copy of this order, the same shall be considered and disposed of in accordance with law within a further period of two months by means of
