By means of this petition filed under Article 226 of Constitution of India, petitioner has prayed for opening of the sealed cover in which his candidature has been fixed for promotion to the post of Sub Inspector. 3. It is contended by learned counsel for the petitioner that the criminal case for which the petitioner's candidature was placed under sealed cover and since he has stood acquitted by the order passed by the Chief Judicial Magistrate on 09.08.2019 in Criminal Case No.1481 of 2011 arising out of Case Crime No.120 of 1997 under Section 223 and 224 of erstwhile Indian Penal Code and appeal preferred by the State against the same being Criminal Appeal No.26 of 2019 has also been rejected by the Sessions Court, Auraiya on 14.03.2023, he can be promoted by opening that sealed cover in the light of the Go
