It is submitted on behalf of petitioner that charges/allegations, both in criminal case as well as in the charge-sheet drawn to institute disciplinary proceedings are same and same evidence is to be led in criminal case by the prosecution and in the disciplinary proceedings by the departmental authority, therefore, in view of relevant provisions contained under Regulation 492 and 493 of the U.P. Police Regulation, propriety demands that departmental action may be put on hold until outcome of judicial trial. Regulation 493 of the said Regulation, itself provides that finding of a Court of law would be final and binding. 2. Learned Standing Counsel could not dispute the above legal position. 3. In the circumstances, therefore, no final order should be permitted to be passed by the Disciplinary Authority until disposal of criminal case, hence it is provided that while the disciplinary proceedings may go on but no
