HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 13268 of 2025 Brham Prakash .....Petitioner(s) Versus State Of U.P. And 3 Others .....Respondent(s) Counsel for Petitioner(s) : Kanchan Sharma, Prashant Vyas Counsel for Respondent(s) : C.S.C. Court No. - 4 HON'BLE AJIT KUMAR, J. Heard Sri Uday Karan Saxena, learned Senior Advocate assisted by Ms. Kanchan Sharma, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has assailed the order of transfer dated 14.08.2025 on the ground that petitioner though has been though shown to be transferred on administrative ground but as a matter of fact, petitioner since served with a show cause notice dated 21.07.2025 pending final order, petitioner has been made to transfer by way of punishment. Per contra it is argued by learned Standing Counsel that if employee is working on a transferable post and is transferred in administrative exigency or even in public interest, no inference may be drawn that transfer is for any pending proceeding. However, he is not averse to a direction being issued for consideration of representation of the petition
