In response to the previous orders of this Court, learned Standing Counsel has obtained instruction by placing the preliminary fact finding enquiry report, the same is taken on record. 2. From the perusal of the instruction, I find that in preliminary fact finding enquiry held in the matter, it clearly surfaced out that the Gram Sabha proceeded to construct a playground by including land reserved for hospital and this was therefore, clear illegality. Construction of a play ground and spending money for development of the same by including a land which is otherwise reserved for other purpose, was found to be prima facie illegal in which petitioner being Panchayat Secreatry was equally held responsible. 3. Having considered the report and having perused the order of suspension, I find that serious allegations have been levelled to this effect that the land reserved for hospital had included the playground.
