After arguing the matter at some length, Shri Nishant Shukla, learned Counsel for the State-appellants submitted that he would first of all move an application before the Writ Court which had passed the order dated 05.07.2023 in Writ A No.19083 of 2016 recording that the order was being passed on consent of the parties which according to the appellant's Counsel was not the case, reserving the right of appeal subsequently if the occasion so arises, in view of this, the appeal may be allowed to be withdrawn at this stage. 4.
