The present petition has been filed with the following prayer: " To issue a writ, order or direction in the nature of mandamus commanding the opposite party no. 2 to 4 to ensure the removal of the illegal encroachment by the opposite party No. 5 to 11 over the Pound land i.e. the Gata no. 110 measuring area 0.512 Hect and Gata No. 107 measuring area 0.3480 Hect which is recorded as Pond in the Revenue Records upon which they have been illegally encroached, in the interest of justice." 2. The learned Standing Counsel, based on instructions from the State, submits that proceedings have already been initiated against the encroachers under Section 67 of the Uttar Pradesh Revenue Code, 2006 and are currently pending. 3.
