HON'BLE MANJIVE SHUKLA, J. Heard Shri Avinash Kumar Srivastava, learned counsel for the petitioner, Shri V. P. Nag, learned Additional Chief Standing Counsel appearing for the State and Shri Mohan Singh, learned counsel appearing for Gram Panchayat concerned. There are three separate allegations by the petitioner against the Gram Pradhan. In respect to one, some enquiry has been conducted as informed by Shri V.P. Nag. With regard to other two alleged illegalities, no instructions are available with him. We are of the opinion that if any illegality has been committed by the Gram Pradhan, as alleged, then the remedy is under Rule 3 of U.P. Panchayat Raj (Removal of Pradhan, Up-Pradhan and Members) Enquiry Rules, 1997 before the District Magistrate. It is said that such a complaint along with an affidavit has been made.
