This petition purportedly in public interest was filed by the petitioner seeking dispossession of the respondent nos. 5 to 9 from the pond of Khasra no. 263 having an area 0.4600 hectare situated at village Awathahi, Tehsil Mohammadabad, District - Ghazipur. 2. A short counter affidavit was filed by the State inter-alia indicating that the area of the aforesaid pond has already been got vacated from the unauthorized possession or encroachment of respondent nos. 5 to 9 on 03.03.2013. Report of the Naib Tehsildar in this regard was annexed with short counter affidavit. 3. In view of the short counter affidavit filed by the State way back on 17.04.2015 to which no rejoinder has been filed and today also none is present, it appears that the petitioner has lost interest in the petition.
