A personal affidavit has been filed today by the Tehsildar, Khair, Aligarh, where in paragraph nos. 7 and 8 it is said that Gata Nos. 133, 134 and 135 have been rid of encroachment after demarcation and the land salvaged from encroachment has been surrounded by wire fencing. Learned Counsel for the petitioner acknowledges the fact that all encroachments has been removed. So far as the public cause espoused in this petition is concerned, no further action is required to be taken. At this stage, learned Counsel appearing on behalf of respondent nos. 5 and 6 states that in carrying out the eviction order, the said respondents' house has been demolished without undertaking the necessary demarcation in accordance with Rules. The said respondents will be at liberty to canvass their cause in the appeal preferred from the order of eviction,
