The grievance of the petitioner is that he wants a Model Fair Price Shop to be constructed in plot no. 60/0.0230 hectares situate in Village- Bilar, Tehsil- Sikandrararu, District- Hathras which is a recorded manure pit. 2. Mr. Santosh Kumar Shukla, learned Additional Chief Standing Counsel, on instructions received points out that the said plot of land is a public utility land, which cannot be put to a different user. It has to be preserved. 3. Learned Counsel for the petitioner argues that the respondents are constructing a Model Fair Price Shop to operate the Public Distribution System in Village- Pahadpur where the population is merely three hundred whereas the population of Village- Bilar is one thousand one hundred.
