HIGH COURT OF JUDICATURE AT ALLAHABAD PUBLIC INTEREST LITIGATION (PIL) No. - 2695 of 2025 Chandradeep Rajbhar .....Petitioner(s) Versus State of U.P. and 2 others .....Respondent(s) Counsel for Petitioner(s) : Amit Kumar Singh Counsel for Respondent(s) : Seema Agarwal (S.C.) Chief Justice's Court HON'BLE ARUN BHANSALI, CHIEF JUSTICE HON'BLE KSHITIJ SHAILENDRA, J. 1. This petition, purportedly in public interest, has been filed by the petitioner seeking a direction that the fair price shop be allotted to a person of OBC category. 2. A perusal of the petition indicates that it is alleged that respondents are seeking to allot the fair price shop to a woman belonging to SC category whereas the same is required to be allotted to the person belonging to OBC category. 3. Filing of a PIL of the present nature seeking to question the category in which the shop is being advertised/allotted, cannot be countenanced. If someone is aggrieved on account of category in which the shop is being advertised/allotted, he has to question the validity in accordance with law. 4. Consequently, the PIL is dismissed.
