This petition, purportedly in public interest, has been filed by the petitioner seeking a direction to respondent nos. 2 and 3 to evict respondent nos. 4 and 5 from Gata No. 776, which is recorded as pond. 2. A perusal of the petition indicates that the Nagar Panchayat has already initiated proceedings by issuing notice to respondent nos. 4 and 5. 3. Filing of the petition by the petitioner, seeking action against respondent nos. 4 and 5 independent of the proceedings already initiated, cannot be countenanced. 4.
