This petition purportedly in public interest has been filed by the petitioner alleging illegal mining and removal of soil from Talab/pond in Gata no. 135Kha and 135Ga recorded as "Jalmagn Bhoomi" in the revenue record of village Narsinghdad, Tehsil - Barhaj, District - Deoria. 2. Instructions have been produced by learned Standing Counsel, which though indicates that they have been sent by the District Collector, essentially have been sent and signed by the Mining Inspector against whom the allegations have been made in the petition. 3. Instructions produced cannot be relied on. 4. Learned Standing Counsel prays for time to seek appropriate instructions from the District Collector, Deoria before the next date. 5.
