Though this Court is convinced that the judgements of the Division Bench in Manbhawati v. State of U.P. and others, 2020 1 AWC 789A as well as that in Writ C No. 7863 of 2018, Brij Bhushan Rai v. State of U.P. and others, decided on 22.02.2018 do not at all bar the petitioner's right in any manner from maintaining this writ petition for enforcement of the order under Section 67 of the U.P. Revenue Code, 2006, yet, in view of the earlier orders of this Court dated 30.04.2024 passed in PIL No. 1672 of 2023, Surendra Malik v. State of U.P. and others, dismissing the aforesaid PIL, earlier preferred by the petitioner, as not maintainable following Manbhawati (supra) and Brij Bhushan Rai (supra), we are constrained to hold that the finality of the earlier order inter partes bars our jurisdiction in entertaining this writ petition.
