At the outset, Dr. Vijender Singh Mehndiyan, learned CGSC raises a preliminary objection to the effect that this petition is not maintainable before this Court as the lis is amenable to adjudication by the Armed Forces Tribunal1. 2. Having seen the provisions of the AFT Act, we are in agreement with Dr. Mehndiyan, as the dispute is clearly a service matter and the petitioner is a person subject to the provisions of the W.P.(C) 13677/2025 3. In that view of the matter, we permit the petitioner to withdraw this writ petition with liberty to prosecute the same cause before the AFT by filing an appropriate original application. 4.
