FACTUAL BACKGROUND: 2. The Petitioner is a company engaged in the business of manufacturing and selling a wide variety of footwear and allied and cognate goods, in addition to offering services in respect of the same. The Petitioner company was founded in the year 2002 and its founders coined the Trade Mark ‘CROCS’ (‘Petitioner’s Mark’) under which the Petitioner’s products are sold. The Petitioner has a wide spread range of more than 300 styles for men, women and children which are popular both in India and abroad. 3. The Petitioner is carrying its business in India through its Indian subsidiary, namely, M/s Crocs India Pvt. Ltd., having its registered office in Gurgaon, Haryana. The Petitioner conducts its activities in the market through se
