This writ petition has been filed for quashing of the First Information Report dated 24.4.2023 giving rise to Case Crime No.990 of 2023 under section 138(1)(b) of the Indian Electricity (Amendment) Act, 2003, Police Station Anti Power Theft, Varanasi, District Varanasi. The petitioner has also prayed that he be not arrested in pursuance of the impugned FIR. 2. Contention of learned counsel for the petitioner is that the offence, as stated in the FIR, is compoundable and the petitioner is ready to apply for compounding the offence for which the FIR was lodged. Learned counsel, therefore, states that the petitioner would file an application before the authority concerned under section 152 of the Electricity Act. 3.
