Although, the prayer made in this writ petition is to quash the First Information Report dated 02.08.2025 giving rise to Case Crime No.0331 of 2025, under Section 353(2) of B.N.S. & Section 3(2)(v) of the S.C./S.T. Act, Police Station - Kotwali Dehat, District - Saharanpur, but at the time when the matter is taken up learned counsel for the petitioner confines his relief to grant of protection under section 35 of Bharatiya Nagarik Suraksha Sanhita, 2023. 3. Contention of learned counsel for the petitioner is that under Section 353(2) of the B.N.S., maximum punishment is five years and, therefore, Section 3(2)(v) of the S.C./S.T.
