This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused-applicant, Jitendra @ Sanju, seeking enlargement on bail in Case Crime No.1192 of 2024, under Section 21/22 of N.D.P.S. Act, Police Station Highway, District Mathura. 3. Learned counsel for the applicant argued that the accused-applicant is innocent and has been falsely implicated in this case due to police rivalry. No any kind of contraband narcotic drugs and psychotropic substance was recovered from the possession of the applicant. It is further submitted that no independent witness was present at the time of recovery and the prosecution has not duly complied with the mandatory provision of Section 42 and 50 of N.D.P.S. Act.
