The present criminal appeal arises from the judgment and order dated 05.12.1984 passed by Shri M.P.S. Tomar, learned III Additional Sessions Judge, Moradabad, in Sessions Trial No.269 of 1983 (State Vs. Nepal Singh, Chhaju Singh, Mohar Singh, Devraj Singh and Shishpal Singh), under Sections 147, 148 and 302/149 I.P.C., Police Station Didauli, District Moradabad. The maximum sentence awarded to them is life imprisonment. 3. By the impugned judgment and order, the learned Court below convicted all the appellants Nepal Singh, Chajju Singh, Mohar Singh, Devraj Singh and Shishpal Singh sentencing them to undergo life imprisonment for the offence under Section 302 read 2 CRLA No.3
