Present criminal appeal has been filed against the judgement and order dated 13.11.1984 passed by Shri K.N. Sinha, III Additional District and Sessions Judge, Varanasi, in Sessions Trial No. 266 of 1981 (State vs Lalji, Horilal and Smt. Sundar). By that order, the learned court below has convicted the accussed Lalji and Horilal for offence under Section 302 I.P.C. read with Section 34 I.P.C. and sentenced them for life. The accused Smt. Sundar Devi, has been acquitted. 3. The prosecution story emerged on the F.I.R. lodged at 09:05 A.M. at Police Station Bhelupur, District Varanasi, under Sections 342, 323, 309 I.P.C. On the face of the F.I
