In paragraph 3 of the said affidavit, it has been stated that the sole appellant Rajbir has already passed away on 30.10.2022 and death certificate issued by Government of Uttar Pradesh has also been annexed along with the compliance affidavit. 3. In verification of his death, statement of Arvind Kumar Gautam, son and Sunita Gautam, daughter-in-law of the appellant- Rajbir has also been recorded. 4. In view of the above, since the sole appellant has already passed away, the instant criminal appeal is dismissed as having been abated. 5.
