The present petition is filed against the order dated 12.12.2009 (hereafter ‘impugned order’) passed by the learned Chief Metropolitan Magistrate (‘CMM’), Tis Hazari Court, Delhi in RC 5(S)/2007/SCU.V CBI/ACU.IX under Sections 3/5 of the Official Secrets Act, 1923 and Sections 409/120B of the Indian Penal Code, 1860 (‘IPC’) whereby the learned Trial Court, in an application filed by the respondents under Section 207 of the Code of Criminal 2.
