After some hearing, learned Counsel for the parties are agreeable to a disposal of this appeal in the following terms: (i) The appellant would not use the device mark for any purpose, pending disposal of the suit. (ii) The respondent would not insist on compliance with the ad interim injunction granted by the impugned order, save and except to the aforesaid extent, till the next date of hearing 2.
