Heard Sri Roopesh Srivastava, learned counsel for the petitioner, Sri Sanjai Singh, learned counsel for the bank and Sri Birendra Pratap Shukla, learned Standing Counsel for the State. 2. Petitioner claims that a third party fraudulently obtained a loan of Rs.7,74,000/- in the name of the petitioner. Another credit of Rs. 56,000/- was similarly fraudulently obtained by third person from the other account of the petitioner. Therefore, the petitioner is not liable for recovery of the said amount. 3. Relying on the bank statement produced by the petitioner, learned counsel for the bank has shown that the entire amount of Rs.7,74,000/- was paid out in the admitted bank account of the petitioner.
