Challenge has been raised to the auction notice dated 18.08.2025 whereby the petitioner's dwelling house was proposed to be auctioned under the SARFAESI Act, 2002. 3. At the outset, Sri Shashi Dhar Sahai learned counsel for the respondent bank states that the property has already been auctioned on 25.09.2025. 4. In view of the fact that third party rights have already intervened and in face of statutory remedy available to the petitioner under SARFAESI Act, interference claimed under Article 226 of the Constitution of India is declined.
