Heard Sri Ram Mohan Mishra, the learned counsel for the petitioner, Sri U.C. Singh, the learned Additional Chief Standing Counsel appearing on behalf of the State and perused the records. 2. By means of the instant writ petition filed in public interest the petitioner has prayed for issuance of a direction for removal of the encroachment from land bearing Gata No.310 measuring 0.376 hectare situated in Gaon Sabha Kachoori, Tehsil Maholi, District Sitapur,which is recorded in the revenue records as a pathway. 3. On the basis of written instructions provided by Sub Divisional Magistrate Maholi, District Sitapur the learned Additional Chief Standing Counsel has submitted that the encroachment in question has already been removed and proceedings under Section 67 of U.P. Revenue Code have
