The instant appeal under Section 173 of the Motor Vehicles Act, 1988 has been preferred by the insurer of Crane No. UP-70-AT-4932 against the impugned judgment and award dated 23.08.2011 passed by the Motor Accident Claims Tribunal/Additional District Judge, Court No.10, Allahabad, in MACP No.100 of 2008, Smt. Vidya Devi @ Masnahi and others vs. Navyug Engineering Company Limited and another, whereby, for the untimely death of Ramkishore Bhartiya in a motor accident that occurred on 02.11.2007, a compensation of Rs.1,70,000/- along with interest at the rate of 6% per annum, has been awarded to the claimants and the insurer of the offending vehicle i.e. the appellant has been ordered to indemnify the above compensation. 2.
