The instant appeal under Section 173 of the Motor Vehicles Act, 1988 has been filed by the insurer of the offending vehicle UP-70-9020, against the impugned judgment and award dated 27.08.2010 passed by the Motor Accident Claims Tribunal/Special Judge, E.C. Act, Allahabad, in Motor Accident Claim Petition No. 616 of 2004 (Dashrath Lal Keserwani and others vs. Rajkumar and another), whereby, for the untimely death of Sanjay Kumar Keserwani on 23.08.2004 due to the injuries sustained in a motor accident that occurred on 07.08.2004, a compensation of Rs.7,62,289/- along with interest at the rate of 6% per annum has been awarded to the claimants, which has been ordered to be indemnified by the insurer of the offending vehicle. 2.
