The present First Appeal is filed under Section 96 of the Civil Procedure Code, 1908 at the instance of the appellant – Madhya Gujarat Vij Company Limited being aggrieved and dissatisfied with the judgment and decree dated 07.12.2010 passed by the learned 4 th Additional Senior Civil Judge, Nadiad (hereinafter be referred to as “the trial Court”) in Special Civil Suit No. 139 of 1998, whereby, the learned Judge partly allowed
