Learned counsel for the applicant submits that though the victim in her statement recorded under Section 183 B.N.S.S. has stated that sexual relations were established between her and the applicant, but at the trial the victim (P.W.2) in her cross-examination has not made any allegation of rape against the applicant and she has not supported the prosecution case and she has been declared hostile, which statement has been filed as Annexure No. S.A.2 to the supplementary affidavit dated 09.07.2025, which is on the record.
