Samiuzzaman Khan, learned counsel for the applicant and Shri Vijay Bahadur Maruya, learned AGA for the State. 2. The instant bail application has been filed seeking release of the applicant on bail in Session Case No. 696 of 2023, arising out of Case Crime No.66 of 2023, under Sections 302, 120B, 34 and 506 IPC, Police Station Bidhnu, District Kanpur Nagar, during pendency of the trial. 3. Learned counsel for the applicant submits that this is the second bail application filed on behalf of the applicant and first bail application of the applicant has been dismissed vide order dated 20.09.2023. 4. He next submits that in the present matter, applicant is in jail since 22.02.2023 i.e. for last more than two and half years and till date out of 42 witnesses of the charge sheet, only 7 could be examined and, therefore, there is no hope of early disposal of the trial.
